Most features of the Service are cross-platform, cross-browser capable however, you understand and agree that you are responsible for downloading and installing the Firefox browser in order to access the service, DarkApp Pro. 3. YOUR REGISTRATION OBLIGATIONS
In consideration of your use of the Service, you represent that you are of legal age and have the proper authority to form a binding contract and are not a person barred from receiving services under the laws of the United States or other applicable jurisdiction. 4. MEMBER ACCOUNT, PASSWORD AND SECURITY
You will receive a password and account designation upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. If we don't notify you first, you agree to (a) immediately notify JCWebDen.com a subsidiary of Darkstar Incorporated of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. 5. MEMBER CONDUCT

g) Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation. Spamming, or the sending of unsolicited email, using an email address, URL that is maintained on an JCWebDen.com a subsidiary of Darkstar Incorporated Service, or directing traffic to a web page that contains any reference to JCWebDen.com a subsidiary of Darkstar Incorporated Services is STRICTLY prohibited. JCWebDen.com a subsidiary of Darkstar Incorporated will be the sole arbiter as to what constitutes a violation of this provision. This action WILL RESULT in immediate termination of your account without refund. Any service interruptions as a result of member spamming will be billed to the member at $50.00 per hour until service is restored. The member will also be in violation of the JCWebDen.com a subsidiary of Darkstar Incorporated Terms Of Service Agreement and subject to legal action (please read our complete Spam Policy).
h) Upload, post, email, transmit or otherwise make available any material that contains software viruses, corrupted data or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
i) Delete any author attributions, legal notices or proprietary designations or labels of any material that you upload, post, email, transmit or otherwise make available;
j) Delete or revise any material posted by any other person or entity;
k) Manipulate or otherwise display the Site by using framing or similar navigational technology;
l) Register, subscribe, attempt to register, attempt to subscribe, unsubscribe, or attempt to unsubscribe, any party for any JCWebDen.com a subsidiary of Darkstar Incorporated product or service if you are not expressly authorized by such party to do so;
m) Disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Service are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges (e.g., excessive shouting, use of all caps, or flooding continuous posting of repetitive text);
n) Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
o) Intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the Federal Trade Commission, any rules of any national or local agency, including, without limitation, the Federal Fair Credit Reporting Act, Title 15, USC 1681, et. seq., the 1999 Graham-Leach-Bliley Bank Privacy Act, the Driver's Privacy Protection Act and any other regulations having the force of law;
p) provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
q) "stalk" or otherwise harass another; and/or
r) search for, collect or store personal data about other individuals for the purpose of misrepresentation, impersonation or in connection with the prohibited conduct and activities set forth in paragraphs a through q above.
You acknowledge that JCWebDen.com a subsidiary of Darkstar Incorporated may or may not pre-screen Content, but that JCWebDen.com a subsidiary of Darkstar Incorporated and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. 8. INDEMNITY
You agree to indemnify and hold JCWebDen.com a subsidiary of Darkstar Incorporated and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, all losses, expenses, damages and costs, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.
9. NO RESALE OF SERVICE

12. TERMINATION

Termination of your JCWebDen.com a subsidiary of Darkstar Incorporated account includes (a) removal of access to all offerings within the Service, including but not limited to JCWebDen.com a subsidiary of Darkstar Incorporated Private Messages, Groups, Chat, Message Boards, (b) deletion of your password and all related information, files and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Service. Further, you agree that all terminations for cause shall be made in JCWebDen.com a subsidiary of Darkstar Incorporated's sole discretion and that JCWebDen.com a subsidiary of Darkstar Incorporated shall not be liable to you or any third party for any termination of your account, any associated email address, or access to the Service.
13. DEALINGS WITH ADVERTISERS

AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS MAKE NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS; (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF JCWEBDEN.COM A SUBSIDIARY OF DARKSTAR INCORPORATED. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
18. EXCLUSIONS AND LIMITATIONS
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 16 AND 17 MAY NOT APPLY TO YOU.

JCWebDen.com a subsidiary of Darkstar Incorporated does accept search or research assignments from attorneys provided the attorney (Client) specifically agrees to indemnify, defend and hold JCWebDen.com a subsidiary of Darkstar Incorporated (DSI), and its officers, employees, agents, representatives, affiliated companies or entities, suppliers, database providers, independent contractors, etc. harmless from and against any and all claims, suits, costs and liabilities whatsoever which may be asserted and/or assessed against JCWebDen.com a subsidiary of Darkstar Incorporated, or its officers, employees, agents, representatives, affiliated companies or entities, suppliers, database providers, independent contractors, etc. based upon any use by Client of any JCWebDen.com a subsidiary of Darkstar Incorporated, system or service and/or based upon any use by Client of any information obtained from/though any JCWebDen.com a subsidiary of Darkstar Incorporated, system or service. This includes any action for damages in any civil court; defense of DSI against any claim by the United States or any Regulatory agency of the United States; or any local, state or federal Grand Jury action. Defense of DSI shall be done by ITS attorneys only, and the costs thereof shall be paid by the Client.
Client understands and agrees that JCWebDen.com a subsidiary of Darkstar Incorporated, does not guarantee, warranty or otherwise promise to provide or obtain any specific result or information in connection with any investigation or request or report or database access or any other work or activity conducted or undertaken or attempted by JCWebDen.com a subsidiary of Darkstar Incorporated, on the behalf of and/or at the request of the Client.
The Client is and will be invoiced / charged, and the Client hereby agrees to pay in full, any and all prevailing applicable charges and costs for databases accessed and/or work and/or activity of any kind conducted by JCWebDen.com a subsidiary of Darkstar Incorporated, on Client's behalf and/or at Client's request, regardless of the (resulting) data or information provided to or obtained by the Client, including Reports stating or reporting a negative or "no record located" result.
Client additionally understands and acknowledges that when requests, data or information submitted to JCWebDen.com a subsidiary of Darkstar Incorporated, by the Client are inaccurate, misspelled or incomplete, it can directly cause and result in no data or incorrect data or information being returned/provided to the Client, and Client is aware and agrees that Client is and will be charged for databases accessed or work or activity conducted/performed based on Client provided information or input data, whether or not the data or information provided by Client is / was accurate or complete.
Client understands and agrees that should any sums of money payable to JCWebDen.com a subsidiary of Darkstar Incorporated, pursuant to this agreement not be paid by Client, thereby creating a need for JCWebDen.com a subsidiary of Darkstar Incorporated, to incur any legal or collection or other expense in connection with JCWebDen.com a subsidiary of Darkstar Incorporated's efforts to collect these monies due, then Client must reimburse JCWebDen.com a subsidiary of Darkstar Incorporated, in full for any and all legal and/or collection and/or other expenses including, but not limited to, attorney's fees and compensation for any time which representatives of JCWebDen.com a subsidiary of Darkstar Incorporated, must expend to collect these monies.
Client also understands and agrees that Client must reimburse JCWebDen.com a subsidiary of Darkstar Incorporated, in full for any and all legal fees which JCWebDen.com a subsidiary of Darkstar Incorporated, or its officers, employees, agents, representatives, affiliated companies or entities, suppliers, database providers, independent contractors, etc. may be required to pay should JCWebDen.com a subsidiary of Darkstar Incorporated, or its officers, employees, agents, representatives, affiliated companies or entities, suppliers, database providers, independent contractors, etc. need to retain legal representation to protect their rights and/or interests in connection with any situation of any kind arising from JCWebDen.com a subsidiary of Darkstar Incorporated, agreeing to provide Client with access to any JCWebDen.com a subsidiary of Darkstar Incorporated, system or service. Client understands and agrees that all legal fees incurred by JCWebDen.com a subsidiary of Darkstar Incorporated, and/or its officers, employees, agents, representatives, affiliated companies or entities, suppliers, database providers, independent contractors, etc. must be reimbursed by Client within thirty (30) days of JCWebDen.com a subsidiary of Darkstar Incorporated's written request.
20. PRICING AND REFUND POLICY
Pricing for the Services is as specified throughout the Site but may be adjusted periodically without notice to you. Charges are billed to the user one time during initial enrollment and are not recurring nor do subscriptions automatically renew after the selected period.
The Site is a "Membership Only" website. New members are encouraged to select a one month trial membership to make sure the Services will meet your needs. Once enrolled, all membership subscriptions are considered final and no refunds are given.
21. NO THIRD-PARTY BENEFICIARIES
You agree that, except as otherwise expressly provided in this TOS, there shall be no third-party beneficiaries to this agreement.
22. NOTICE
JCWebDen.com a subsidiary of Darkstar Incorporated may provide you with notices, including those regarding changes to the TOS, by email, regular mail or postings on the Service.

25. GENERAL INFORMATION
Entire Agreement. The TOS constitutes the entire agreement between you and JCWebDen.com a subsidiary of Darkstar Incorporated and governs your use of the Service, superseding any prior agreements between you and JCWebDen.com a subsidiary of Darkstar Incorporated with respect to the Service. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other JCWebDen.com a subsidiary of Darkstar Incorporated services, affiliate services, third-party content or third-party software.
Choice of Law and Forum. The TOS and the relationship between you and JCWebDen.com a subsidiary of Darkstar Incorporated shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. You and JCWebDen.com a subsidiary of Darkstar Incorporated agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Marion, Florida.
Waiver and Severability of Terms. No Right of Survivorship and Non-Transferability. Upon receipt of a copy of a death certificate, your account may be terminated and all contents therein permanently deleted.
Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.
